Effective this year, California employers are prohibited from asking for an applicant1‘s salary history. In addition, employers are required to provide pay scale2 information, upon reasonable request3, to the applicant for the position being applied. It is acceptable for the employer to ask an applicant for salary expectations.

 

  1. An applicant is defined as an individual seeking employment who is not currently employed with that employer in any capacity or position.
  2. Pay scale is defined as a salary or hourly wage range for the applied position.
  3. A reasonable request is defined as a request made by the applicant after they have completed the initial interview with the employer, preventing someone unqualified for a position from obtaining salary range information about it.
